MEDIATION SERVICES

Attitude & Behaviour

Where appropriate, Intersol are dedicated to resolving disputes quickly, confidentially, and cost-effectively. Rather than force resolution on participants, our team encourages them to get involved at every stage of the process, from identifying the problem to crafting the resolution, assisting participants to navigate conflict positively and successfully.

Formal disputes can be particularly challenging to those involved; situations can often be felt very personally. At Intersol we are acutely aware how deeply emotional such mediations can be. We are experts in handling highly emotive situations and bring them to a successful conclusion.

Our focus and emphasis are as much on emotional resolution as it is financial, and we position the parties at the heart of our mediations, empowering them to arrive at their own resolution with facilitated support and guidance, treating all participants equally and with respect

Mediation v Litigation/Formal Hearing

  • Mediation is cost effective: costs are a fraction of the price of litigation/Formal Hearing.

  • Mediation is personally satisfying it is led by the participants, with the guidance of a professional mediator. Participants determine the resolution.

  • Mediation is confidential: it is not part of a public court, and the content of a mediation process cannot be used in subsequent court proceedings i.e., it is without prejudice.

  • Mediation is quick: disputes are resolved in a much shorter timescale to that of formal hearings.

  • Mediation is not statutory: a decision is never forced upon the people involved.

  • Mediation is voluntary: all parties agree to take part in the process.

A successful mediation is built on trust and confidentiality is a pillar within the process. The process can be flexible but is usually dealt with in one day involving private and joint meetings, the decision of which comes from the participants. The finer details of how the mediation will be run can be arranged to suit each individual case.

Listening to both sides to be enlightened, Intersol’s mediation team is headed by Richard (Dick) Bull, a qualified civil, commercial, workplace and employment mediator. As a faculty member of the Society of Mediators, Richard also trains and qualifies the skills, a subject matter expert who also trains common to the Intersol ethos. His diverse and extensive team includes qualified and highly talented mediators from a range of professional backgrounds, ensuring an equally diverse skill set to deal with any mediation.

He says:

“With effective communication and consideration, I believe it is possible to resolve any dispute fairly, with universal human values at the centre of things. I am passionate about the power of mediation — simply because I have facilitated resolution in so many different situations.”
