Rape Prosecution ProcessWhilst we are not directly involved in the investigation of rape to the criminal standard of proof, we are very much involved in its investigation to the civil standard (known as balance of probabilities) in discipline investigations. It is therefore crucial to understand ALL the moving parts of rape investigation case management, and maintain a 'weather-eye' on the potential for an investigation to 'go criminal'.IF you opt to go to the police and report, this is an excellent summary of the process that follows if and when your case reaches the CPS.Note the repeated reference to investigation.
